Under California Senate Bill 407, the Birthday Rule lets anyone with an active California Medigap policy switch to a plan with the same or fewer benefits, offered by any insurance company, during the 60 days that begin on their birthday. You cannot be turned down or charged more for a pre-existing condition during this window.
